TERMS OF GUARANTEE
(for construction woodwork produced by Okland Sp. z o.o. (Ltd.) – valid as of 21/08/2008)
§ 1
1) The present terms of guarantee refer to construction woodwork products of Okland Sp. z o.o., hereinafer called the Producer.
2) A detailed list of products covered by the guarantee is determined each time between the parties in a sale contract for construction woodwork.
3) Signing a sale contract for construction woodwork signifies acceptance of the terms of guarantee.
4) Articles paid for partially are not covered by the guarantee.
Lack of payment in due time terminates the guarantee.
§ 2
1) The producer grants guarantee on construction woodwork products manufactured in conformity with the standard accepted and implemented at Okland Sp. z o.o.
2) The guarantee covers product defects resulting from poor workmanship or material defects. The guarantee term commences as of the date of sale of woodwork, registered in the guarantee certificate.
3) Guarantee periods:
a) Window woodwork – 5 years
b) Envelope fittings – 5 years
c) Fittings for slide-fold doors – 1 year
d) Door bolts, hinges, inserts, handles and closers – 1 year
e) Insulated glass integrity – 5 years
f) Paint coatings:
¨ Covering coatings – 4 years
¨ Dark stain coatings – 3 years
¨ Light stain coatings – 2.5 years
4) The conditions of it. refer to construction woodwork mounted by an authorized assembly team of Okland Sp. z o.o.
5) For those who carry out assembly on their own the following guarantee periods apply:
a) Window woodwork – 3 years
b) Envelope fittings – 2 years
c) Door bolts and hinges – 6 months
The remaining unchanged.
§ 3
1) Complaints should be made only in writing (registered letter, fax, e-mail or personally at the place of purchase or the producer).
A complaint report should include the following data:
Date and place of reported complaint
Name and surname of the claimant
The address at which the articles in question are located
Additional data facilitating contact (tel., e-mail)
Guarantee certificate number
The name of the faulty element (communicating the order data is advisable) and a thorough description of the reported defects
Legible signature of the claimant
2) The day on which defects were reported is determined as the day on which this information actually reached the producer.
3) The above terms of guarantee refer exclusively to those buyers for whom the articles were installed on the territory of the Republic of Poland.
4) Telephone complaints will not be acted upon, nor considered as official complaint reports.
§ 4
1) Taking advantage of the guarantee signifies making a claim that the producer gratuitously remove defects and shortcomings.
2) An abuse of the right to guarantee and unfounded, unjustified calls for the producer’s service employees will lead to the seeking of cost refunds in return, including the cost of travel and workmanship according to the valid list of prices.
§ 5
1) An acceptance of a complaint report by the Producer does not oblige him to eliminate the defects. Within 14 days from the date of reporting the defects the Producer or his representative will respond to the Ordering party as to the further complaint procedure.
2) The ordering party will grant access for the producer or his representative to the product in question in order to perform an inspection and remove the defects.
3) If it was impossible before, the defects will be removed within 30 days from the date of confirmation by the Producer or his representative of the reported and approved defects and shortcomings.
4) The producer will do his utmost to remove the defects as quickly as possible.
§ 6
1) The guarantee does not cover:
Mechanical damage: to paint coatings, window woodwork and fittings
Damage caused by improper use and maintenance
Damage resulting from fortuitous events (e.g. burglary, inundation, fire etc.)
Normal wear from use
Minor shortcomings with no effect on the use of the product
External scratches, cracks in the glass, pane retting, vapour accumulation, colour defects, concavity or convexity of the glass, muntin knocking and interference effects
Defects of the glass located inside the insulated unit, such as: scratches, dirt etc. reported after the lapse of 12 months from the date of production which is printed on the internal frame of the insulated unit
Damage resulting from woodwork having been installed or stored in detrimental conditions with excessive air humidity in the rooms (insufficient ventilation, jobs involving moisture performed after the installation of the woodwork), such as: discolouration, cracks in the coating, depreciation of the elements and subassemblies due to the swelling of wood
Products in which certain characteristics become revealed which result from the use of coniferous wood, e.g. resin leakage
Visible figure of wood (raised natural grain of wood)
Small tight knots
Coating colour variations on the elements caused by natural colour of the wood, the natural grain of the wood or its non-uniform texture
Defects stemming from unauthorised assembly
Products manufactured on the customer’s demand, without compliance with the processing standards (e.g. balconies without crosspieces, exceeded dimensions as defined by the Polish Standard)
Products on which the customer obtained a discount due to lasting defects
2) In case the assembly is performed by a team authorised by Okland Sp. z o.o. the Producer considers himself bound to perform a one-time adjustment after the assembly on the orderer’s demand.
3) If the assembly is carried out individually any adjustment or maintenance will be the buyer’s responsibility. The fittings should be restored at least once a year.
4) The ordering party will maintain the paint coating at least twice a year with a preservative for acrylic coatings. The following agents are available, i.a.: SIGMA Holzpflegemilch, GORI 911 maintenance gel; LAKMA – a kit for preserving window woodwork and fittings. Non-maintained windows are not covered by the guarantee on paint coating.
§ 7
1) As proof of granting a guarantee the Producer issues 2 Guarantee Certificates (1 for the buyer and 1 for the company files)
§ 8
1) Any repairs or modifications of the product during the guarantee period performed without the producer’s authorisation cause the rights resulting from the present Terms of Guarantee to become null and void.
